GENERAL TERMS AND CONDITIONS OF USE — ClamCams.com

1. Introduction

This document governs access to and use of the ClamCams.com platform, owned by YJRMEDIA LLC, based in Georgia, USA.

2. Acceptance of Terms

By using the Platform, you agree to be legally bound by these Terms and Conditions.

3. Age Requirements

Only individuals who are 18 years of age or older, or who have reached the age of majority in their jurisdiction (whichever is greater), may use the Platform.

4. 2257 Statement of Compliance

All performers featured on ClamCams were at least 18 years old at the time of content creation. All records required by 18 U.S.C. § 2257 are maintained and available for inspection.

5. Account Registration

Users must provide truthful information and are responsible for all activities conducted under their account.

6. Use of the Platform

Users must comply with community guidelines and avoid illegal, abusive, or fraudulent activities.

7. ClamCams Code of Conduct

Includes rules on user conduct, member content, and sanctions for violations.

8. User Content

Members retain rights to their content but grant ClamCams a non-exclusive license to use, promote, and store such content in accordance with these Terms.

9. Billing and Tokens

Deposits convert into non-refundable tokens, except under special conditions. Conditioning tokens to specific acts is prohibited.

10. Privacy and Cookies

Use of the Platform implies acceptance of our Privacy Policy and the use of cookies and tracking technologies.

10A. Fraud and Chargeback Policy

Users must attempt resolution with ClamCams support before initiating any chargeback. Unauthorized chargebacks may lead to account suspension and forfeiture of funds. All chargeback-related communications must be directed to billing@clamcams.com.

11. Contests

Open only to verified users; governed by Georgia law and contest-specific rules.

12. ClamCams Affiliate Program

Outlines ethical promotion requirements, commission rules, and termination clauses.

13. Intellectual Property

All platform materials are protected by applicable copyright and intellectual-property laws.

14. DMCA and Infringing Content

Infringement claims must be submitted via formal DMCA notice to the Designated Agent.

15. Account Termination

Accounts may be terminated for violations. Content removal upon request is not guaranteed if stored externally.

16. Limitation of Liability

The Platform is provided “as is.” Maximum liability is limited to USD $250 or the unused token balance, whichever is lower.

17. Arbitration and Dispute Resolution

Disputes will be resolved by individual arbitration in Georgia under AAA rules and the Federal Arbitration Act.

18. Governing Law

These Terms are governed by the laws of the State of Georgia, USA.

19. Refund Policy

All transactions are final and non-refundable, except for:

• Unauthorized charges reported within 72 hours.
• Technical failures preventing service delivery (e.g., uncredited tokens).

Refund requests to support@clamcams.com must include registered email or username, transaction ID, and a brief explanation. Responses within five (5) business days.

21. Abuse Monitoring

The platform monitors login and transaction patterns using IP/device matching, login frequency, and geolocation checks. Suspicious activity may trigger warnings, suspension, or bans.

22. Automated Monitoring and Moderation

To ensure policy compliance, participant safety, and adherence to legal and payment-processor requirements, ClamCams employs automated monitoring systems, including artificial intelligence, across all areas of the platform (public and private streams, chats, profiles, and user-generated content). These systems may detect prohibited behavior, illegal content, or operational risks. By using the platform, you expressly agree to this continuous automated monitoring as a condition of participation.
