GENERAL TERMS AND CONDITIONS OF USE — ClamCams.com

1. Introduction

This document governs access to and use of the ClamCams.com platform, owned by YJRMEDIA LLC, based in Georgia, USA.

2. Acceptance of Terms

By using the Platform, you agree to be legally bound by these Terms and Conditions.

3. Age Requirements

Only individuals who are 18 years of age or older, or who have reached the age of majority in their jurisdiction (whichever is greater), may use the Platform.

4. Account Registration

Users must provide truthful information and maintain the security of their login credentials. Users are responsible for all activities conducted under their account.

5. Use of the Platform

Users agree to comply with community guidelines and to refrain from engaging in illegal, abusive, or fraudulent activities within the Platform.

ClamCams Code of Conduct

All terms used in this Code of Conduct have the meaning assigned in the General Terms of Service.

A. User Conduct

• Comply with all applicable laws.
• Do not share, solicit, or engage in illegal, defamatory, obscene, violent, or discriminatory content.
• Maintain the confidentiality of personal information.
• Do not record or capture transmissions without consent.
• Do not violate intellectual property rights.
• Do not send spam or unsolicited promotions.
• Do not use bots or deceptive techniques.
• Do not allow access to minors or promote child pornography.
• Do not broadcast under the influence of drugs or alcohol.
• Do not broadcast from public places without permission.

B. Member Content Rules

• Content involving child pornography, violence, illegal drugs, bestiality, incest, or scatology is strictly prohibited.
• Offensive or discriminatory role-playing is prohibited.
• Pretending to be asleep is prohibited.
• Presence of minors or animals on camera is prohibited.
• Use of unauthorized devices without approval is prohibited.

C. Sanctions

We may immediately suspend or terminate accounts, remove infringing content, and report illegal conduct to the appropriate authorities.

6. User Content

Members retain rights to their content, granting the Platform a non-exclusive license to use, promote, and store such content in accordance with the established terms.

7. Billing and Tokens

Deposits are converted into non-refundable tokens, except for the withdrawal of unused balances under specific conditions. Conditioning tokens to specific acts is prohibited.

8. Privacy and Cookies

By using the Platform, you agree to our Privacy Policy and the use of cookies and tracking technologies as described therein.

9. Contests

Participation is limited to verified users and subject to the laws of the State of Georgia.

General Eligibility Rules for ClamCams Contests

A. Definitions: Terms not defined herein shall have the meanings assigned in the General Terms of Service.
B. Participation and Eligibility: Limited to Community Members who have verified their age; void where prohibited by law.
C. Contest Periods: Each contest will have a published start date and, if applicable, an end date.
D. Participant Conduct: We reserve the right to disqualify participants who tamper with the process or provide false information.
E. Prizes: Described in each contest; none if insufficient eligible participants.
F. Cash Prize Claims: Claim form, official ID, and payment method required; unclaimed balances under $50 USD will not be processed.
G. Waiver of Legal Proceedings: Participants waive litigation related to contests; disputes resolved per arbitration in the Terms of Service.
H. General Conditions: Governed by the laws of Georgia, USA; we may correct errors without notice.

10. ClamCams Affiliate Program

A. Definitions: As in General Terms.
B. Program Participation: Open to registered users of legal age; prior approval required.
C. Affiliate Obligations: Promote ethically; no spam or deceptive practices.
D. Commissions: Based on current rates and valid referrals; rates may change with notice.
E. Payments: Monthly if minimum reached; balances roll over.
F. Limitations: No commission for fraud or self-referrals; violations lead to termination.
G. Termination: ClamCams may terminate for breach.
H. Governing Law: Governed by Georgia, USA laws.

11. Intellectual Property

All materials on the Platform, including software and content published by us, are protected by copyright and other intellectual property laws.

12. DMCA and Infringing Content

We respect intellectual property rights in accordance with the DMCA. Content removal can be requested by sending a formal notice to the Designated Agent.

13. Account Termination

The Platform may terminate accounts at any time for violation of these Terms. Users may request removal of prior content, though copies outside our control cannot be guaranteed removed.

14. Limitation of Liability

The Platform is provided “as is.” Maximum liability is limited to $250 USD or the unused token balance, whichever is less.

15. Arbitration and Dispute Resolution

Any dispute will be resolved through individual and binding arbitration in Georgia, under AAA rules and the Federal Arbitration Act.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Georgia, USA.
